These Terms and Conditions (“Terms”) govern your access to and use of the Aligned to Achieve (A2A) digital platform, framework, reports, and related materials provided by TCS Insights Pty Ltd (“we”, “us”, “our”).

By creating an account, purchasing a subscription, or using A2A, you agree to these Terms. If you do not agree, you must not use A2A.

1. What A2A Is

A2A is a strategic alignment and decision-support platform designed to help organisations and facilitators identify goals, blockers, priorities, and actions, and to generate structured alignment reports. A2A combines a proprietary card-based framework with a digital facilitation and reporting platform. A2A supports thinking, discussion, and alignment and does not provide legal, financial, or business advice.

2. Subscription, Pricing and Cards

Access to the A2A digital platform is provided on a subscription basis:

– AUD $120 per month, billed monthly in advance; or

– AUD $1,300 per year, billed annually in advance.

Subscriptions renew automatically unless cancelled before the next billing date.

All first-time customers are required to purchase the official A2A Card Set as a one-off purchase. The card set forms an essential part of the A2A methodology.

Payments are processed by a third-party provider. Prices are in AUD and exclude GST unless stated. No refunds are provided for partial subscription periods.

3. Licence to Use A2A

We grant you a limited, non-exclusive, non-transferable, revocable licence to use A2A during your active subscription period.

This licence allows you to:

– Use A2A internally within your organisation

– Use A2A to facilitate workshops and engagements with your own clients

– Generate reports using the A2A platform

– Charge clients professional or consulting fees for services provided using A2A

This licence does not permit resale, sublicensing, white-labelling, or creation of competing products. Clients do not acquire rights to A2A.

4. Intellectual Property

All intellectual property in A2A remains ours, including the framework, cards, platform, reports, and any enhancements. You must not copy, reverse engineer, or recreate A2A or represent it as your own intellectual property.

5. Inputs, Data and Reports

You are responsible for all inputs, card selections, comments, edits, and modifications entered into A2A.

Reports are generated based on user inputs and may be edited or re-run. We do not guarantee accuracy or completeness. Responsibility for reviewing, validating, and using reports rests entirely with you.

Reports may be shared with clients as part of your services but must not be sold as a standalone product.

6. Acceptable Use

You agree to use A2A lawfully and in accordance with these Terms. We may suspend or terminate access for misuse, non-payment, or breach.

7. No Guarantees

A2A is a decision-support tool only. We do not guarantee outcomes or results.

8. Limitation of Liability

To the maximum extent permitted by law, our liability is limited to the fees paid by you in the 12 months preceding the claim. We are not liable for indirect or consequential loss.

9. Termination

You may cancel at any time. Access continues until the end of the billing period. No refunds apply. We may terminate for breach or non-payment.

10. Governing Law

These Terms are governed by the laws of Victoria, Australia.
